The Contractor hasn’t corrected a Defect

Client side: Defects

We notified this Defect months ago and it still isn't fixed. Can we bring someone else in?

Where the contract stands

Yes, if the Defect was notified and the Contractor was given access but did not correct it within the defect correction period. The Project Manager then assesses the cost of having other people do it, and the Contractor pays (46.1 in NEC4, 45.1 in NEC3). Get those conditions in place first, in that order.

Read the guide: Contractor won't correct a Defect

This is our plain-English summary, not legal advice. Your own contract, including any Z clauses, decides.

In Contract Status, step by step

  1. Check the notice and the reply

The record holds the notification, the date, the Contractor's reply with the fault, cause and action, and any discussion.

Defect D-0003 from the Client side with the notification details and the contractor's reply, and a Close Defect button

D-0003: the promised action and date are on the record.

  2. Record the correction by others

Further down the record, Mark as corrected by others closes the Defect with this record, and the amount the Contractor pays is shown on the final account.

A panel titled corrected by others with the explanation and a Mark as corrected by others button

The clause shown comes from the contract's clause list.

  3. Keep the register honest

The Defects Register shows what is open and when each was replied to, and the contract page shows the open count on its tile.

Only the Client side closes a Defect.

What happens next on the other side

The Contractor sees the Defect closed, and the sum appears on the final account. Contract health can date each Defect once the defect correction period is recorded for the contract.
