NEC international use is well established, with Hong Kong the clearest example of a government adopting the contracts for public works. NEC was written to work in any location, but a UK template won't simply transfer: you'll need to replace the UK-specific Options, choose suitable dispute terms and check your contract against local law.

This page covers where NEC is used and what to change. Local law can change anything here, so get advice in the relevant country. To see NEC against the main international alternative, read NEC vs FIDIC, and for other comparisons, return to the comparisons section.

Where NEC is used

PlaceWhat is publicly known
Hong KongThe NEC4 documents carry a statement from the Development Bureau of the HKSAR Government recommending a progressive move from NEC3 to NEC4 in public works, with suitable local amendments. NEC reports a Hong Kong edition of the ECC, launched in 2023.
South AfricaA long-established market, where NEC has been recognised for public sector use alongside other international forms. Check the current position with the Construction Industry Development Board.
New Zealand and AustraliaNEC reports growing use and has worked on local provisions in New Zealand. Local standard forms remain strong in both countries.
PeruThe venues for the Lima 2019 Pan American and Parapan American Games are a commonly cited NEC project.
IrelandNEC is used on some projects, but public works there have their own standard contract suite. Check which contract applies.

Much of the published information comes from NEC itself, so treat claims about how widely it's used as the publisher's own. We give no usage figures here because we can't verify them independently.

What needs to change from a UK contract

ItemUK habitWhat to do elsewhere
Y(UK)2Applies the Construction Act payment rulesRemove it where the Act doesn't apply. Check any local payment legislation
Y(UK)1 and Y(UK)3Project bank account; third party rights under UK lawNormally remove them, then deal with local equivalents through local Y clauses or Z clauses
Dispute OptionW2 for contracts under the Construction ActUse W1 or consider W3 instead, depending on the contract's law
Law and languageEngland and Wales, or Scotland; EnglishSet them in the Contract Data. A translated contract needs a stated controlling language
CurrencySterlingConsider Option X3 if part of the payment is in another currency
WeatherA UK weather stationSelect a suitable measurement place and weather data for 60.1(13). If reliable data doesn't exist, address this in the Contract Data
TribunalLitigation or arbitration in the UKThink about enforceability against the other party's assets. International arbitration is often considered for this reason

Things that are easy to miss

  • Mandatory local law. Rules on insurance, decennial liability, tax, permits, labour, and termination may override what a contract says.
  • Time bars. Some legal systems treat notice provisions such as 61.3 differently. Get advice before relying on one.
  • Good faith. In some civil law countries, clause 10.2 may sit alongside an obligation of good faith that goes beyond what a UK reader expects.
  • Taxes. Check how Defined Cost, payments and the Schedule of Cost Components treat local taxes, charges and overseas staff.
  • Subcontract alignment. A local subcontractor may be on another form, which can leave gaps in how time limits flow down.
  • Language. NEC's defined terms and present-tense style can be hard to translate faithfully, so test the translation with people who will actually use it.
  • Experience. Local supply chains may not have seen NEC. Allow time for training and for bidders' questions.

An illustrative example

A fictional UK contractor wins a water treatment job in another country, on a client-drafted NEC4 ECC, with the template based on an old UK job. A review finds Y(UK)2 still included, W2 still selected, a UK weather station in the Contract Data and insurance terms that don't match local rules. None of these would stop the job, but each could cause an argument at the worst moment. Fixing them at tender stage takes a short review by a local lawyer alongside someone who knows NEC.
